trained in its ability compete, and (4)
the harm it suffers as a result of the
discrimination would likely redound
to the harm of broadband users."
(Few, if any, small providers today
can bear the prohibitive costs of
litigating antitrust claims. Very few
even file such claims, however clear
the violations may be, because they
know theyll be tied up in years of
litigation assuming they can sur-
vive that long -- while the violators
continue to engage in the unlawful
practices at issue. These proposals
would be just as onerous and thus
just as ineffective in protecting the
providers for whose benefit they
are supposedly intended. JB)
